Terms of Service

Binding Agreement: By registering for, accessing, or using the Consisto application or any associated module ("Service"), you ("User" or "Subscriber") agree to be bound by these Terms of Service. If you do not agree, you must immediately cease use of the Service.

1. Acceptance of Terms & Scope

These Terms of Service constitute a legally binding agreement between you and Consisto ("we," "us," or "our"), governing your access to and use of the Consisto web application, including student portals (`app/`), test attempt engines (`app/s/`), teacher dashboards (`teacher/`), school administrative interfaces (`school/`), computer-based testing engines (`cbt/`), live classrooms (`Consisto Meet`), and AI features (`cAI`).

If you are accepting these Terms on behalf of an educational institution, school, or legal entity, you represent that you possess full legal authority to bind such entity to these Terms.

2. License Grant & Restrictions

Subject to ongoing compliance with these Terms and payment of applicable fees, Consisto grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal educational or institutional test prep purposes.

  • You may not modify, reverse engineer, decompile, or disassemble any portion of the Service.
  • You may not rent, lease, sell, redistribute, or sublicense access to the Service.
  • You may not attempt to bypass rate limits, bot protections, authentication controls, or automated moderation filters.

3. Account Roles & Security

Account creation requires accurate, complete information. You are solely responsible for maintaining the confidentiality of account credentials, authentication tokens, and cryptographic keys.

  • Student Accounts: Assigned to individual learners. Students must maintain academic integrity during examinations.
  • Teacher Accounts: Assigned to educators. Teachers must properly scope subject and class assignments during onboarding and maintain appropriate conduct.
  • School Administrator Accounts: Assigned to designated school officials. School admins oversee institution billing, student/teacher rosters, and content settings.

4. Specialized Modules & Disclosures

  • End-to-End Encryption (E2EE): Consisto utilizes Zero-Knowledge encryption for specific features (e.g., private journals). We do not store your private decryption keys. If credentials are lost, E2EE data is permanently unrecoverable.
  • Consisto Meet: Real-time classrooms operate via enterprise WebRTC infrastructure. Attendance is calculated using automated 30-second presence heartbeats.
  • cAI Integration: AI assistance (powered by Google Gemini) provides educational hints, subjective grading help, and doubt explanations. AI outputs are supplementary and do not replace formal teacher evaluation.
  • CBT & DHA Examinations: Test sessions monitor focus loss and enforce violation limits with automatic submission.

5. Payment, Billing & Refunds

Subscription plans (e.g., Consistency ₹49/mo, Plus ₹199/mo, or institutional billing) are processed via secure payment gateways (Razorpay). School invoices are auto-calculated from active student/teacher tiers. Refund policies are governed by our separate Refund Policy.

6. Limitation of Liability & Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONSISTO, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

You agree to indemnify and hold harmless Consisto against any third-party claims, liabilities, damages, or expenses arising from your violation of these Terms or misuse of the Service.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in New Delhi, India.

8. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after revisions become effective constitutes acceptance of the updated Terms.
