Terms of Service
1. Acceptance of Terms
These Terms of Service constitute a legally binding agreement made between you and Consisto ("we," "us," or "our"), concerning your access to and use of the Consisto web application and associated services.
If you are accepting these Terms on behalf of an educational institution, company, or other legal entity, you represent that you have the authority to bind such entity to these Terms.
2. License to Use
Subject to your ongoing compliance with these Terms and payment of applicable fees, Consisto grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal or internal educational/business purposes.
- You may not modify, reverse engineer, decompile, or disassemble the Service.
- You may not rent, lease, lend, sell, redistribute, or sublicense the Service.
- You may not use the Service for any illegal or unauthorized purpose.
3. Account Registration & Security
You must provide accurate, complete, and current information when registering for an account. You are solely responsible for safeguarding the password and cryptographic keys that you use to access the Service.
Crucial Notice regarding End-to-End Encryption (E2EE): Consisto utilizes Zero-Knowledge encryption for specific features (e.g., Journals). We do not possess your decryption keys. If you lose your password, your E2EE data is permanently irretrievable. Consisto holds no liability for data loss resulting from forgotten credentials.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONSISTO, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
Under no circumstances will Consisto be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Service or your account.
5. Indemnification
You agree to defend, indemnify, and hold harmless Consisto and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service, or your violation of these Terms.
6. Governing Law & Arbitration
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of the arbitration shall be New Delhi, India.
7. Modifications to the Service and Terms
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We may also revise these Terms from time to time. The most current version will always be posted on our legal hub. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms.
